Many Florida homeowners who are facing foreclosure have become victims of foreclosure scams. Unfortunately, many unlicensed and, in most cases, unscrupulous individuals are taking advantage of the fear and ignorance of Florida homeowners. About a year ago, Florida Foreclosure Fraud Prevention Act came into force in an effort to help Florida homeowners avoid becoming a victim of such scams. Here are some things you need to know how to protect against foreclosure fraud.
Beware of advance fee: Nonlawyers can not charge a fee for foreclosure services until the completion of all works as promised. There are many so-called "foreclosure consultants" and "foreclosure prevention companies" who promise to help you avoid foreclosure and stay in your home. What ends up happening is that these companies are large sums of money up front, sometimes several thousand dollars, and do nothing. It is illegal. Do not give money to any consultant, advisor or any other non-lawyer who promises you a foreclosure service.
Unsolicited Advice: Some of these so-call company owner who served in foreclosure or even pay a visit to their homes. You should be concerned with anyone who contacts you by phone or in person. These are usually scams.
Nothing in writing: Florida Foreclosure Fraud Prevention Act requires that anyone providing foreclosure to give you a written contract and make you a "cooling off period" with the right to cancel during the signing. Beware of anyone who asks for money or without the provision of service contracts or trying to get you to sign a contract without thinking.
Do not talk to a bank representative: The law also requires any "foreclosure consultant" or foreclosure of a lawyer to advise you, in writing, you have the right to contact the bank and negotiate, because the bank may be willing to negotiate with you free. Be careful who you say you do not communicate with the bank.
